Terms of service
The rules that govern your use of GetPureProof. Plain language where possible, precise where it has to be.
Last updated: April 21, 2026
Effective date: April 21, 2026
These Terms of Service ("Terms") govern your access to and use of GetPureProof (the "Service"), a video testimonial platform operated by WebCrafters Sp. z o.o., a company registered in Poland ("GetPureProof", "we", "us", or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- Service — the GetPureProof platform, including the website, dashboard, recording widget, embed widgets, APIs, and all related features.
- Account — your registered user account on GetPureProof.
- Customer — the individual or business entity that registers an Account and pays for a subscription (you).
- End User — a person who records, submits, or interacts with content through your Spaces (typically your customers leaving testimonials).
- Content — any video, audio, text, image, or data submitted to or generated by the Service, including testimonials recorded by End Users.
- Space — a project unit within GetPureProof used to organize collection campaigns and embeds.
- Subscription — a paid plan giving access to features beyond the free tier.
2. Account registration
To use most features of the Service, you must create an Account. By registering, you confirm that:
- You are at least 18 years old or have legal capacity to enter into a binding contract.
- You provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your Account.
You must notify us immediately at contact@getpureproof.com if you suspect unauthorized access to your Account.
We reserve the right to refuse registration, suspend, or terminate Accounts at our discretion, particularly in cases of suspected fraud, abuse, or violation of these Terms.
3. Subscriptions, payments, and billing
3.1 Plans and pricing
GetPureProof offers a free plan and paid Subscription plans. Current pricing is published on /pricing. We reserve the right to change pricing for new subscriptions at any time. For existing subscribers, material price changes will be communicated by email at least 30 days in advance.
3.2 Free plan
GetPureProof offers a free plan with limited features (1 Space, 2 video testimonials per month, standard embeds, GetPureProof branding). No payment method is required. The free plan is available indefinitely subject to these Terms — you can upgrade to a paid plan at any time, or stay on free as long as you respect the plan's limits and our Acceptable Use Policy (Section 6).
3.3 Billing cycle
Paid Subscriptions are billed in advance on a recurring monthly or annual basis, depending on the plan you select. Payments are processed via Stripe. By providing payment details, you authorize us (through Stripe) to charge the applicable fees to your selected payment method.
3.4 Automatic renewal
Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before renewal. You can cancel anytime from your dashboard settings.
3.5 Failed payments
If payment fails, we will retry the charge over several days. If payment cannot be collected, your Account will be downgraded to the free plan and paid features will be suspended until payment is restored.
3.6 Taxes
Prices displayed do not include VAT or other applicable taxes unless explicitly stated. You are responsible for any taxes owed in your jurisdiction. For EU business customers, reverse charge VAT may apply where eligible.
4. Refund policy
4.1 Consumer refund window (EU)
If you are an EU consumer, you have the right to withdraw from a paid Subscription within 14 days of the first payment, in accordance with EU consumer protection law. To exercise this right, email contact@getpureproof.com with your withdrawal request.
4.2 Business customers
For business customers, we offer a goodwill 14-day refund window from the first payment of any new paid Subscription. After this window, payments are non-refundable.
4.3 Cancellations
You can cancel your Subscription at any time. Cancellation takes effect at the end of the current billing cycle. You retain access to paid features until that date. We do not provide pro-rata refunds for unused time within a paid period.
4.4 Downgrades
If you downgrade to a lower-tier plan or to the free plan mid-cycle, you retain access to your current plan until the end of the billing period. The new plan applies from the next cycle. Pro-rata credits are not issued in cash but may be applied to your account at our discretion.
4.5 Refunds for service failures
If the Service experiences a prolonged outage attributable to us, we may issue partial refunds or service credits at our discretion. Contact support to request review.
5. Content ownership and license
5.1 Your content
You and your End Users retain all ownership rights to Content submitted to the Service. We do not claim ownership over your videos, testimonials, or any other materials.
5.2 License to operate the Service
By submitting Content, you grant GetPureProof a worldwide, non-exclusive, royalty-free license to host, store, transmit, transcode, display, and serve that Content solely for the purpose of operating the Service on your behalf. This license terminates when you delete the Content or when your Account is permanently closed (subject to grace periods described in Section 7).
5.3 End User consent
You are responsible for ensuring that End Users who submit Content (e.g., customers recording testimonials) have given valid consent for that Content to be collected, stored, and used by you. GetPureProof provides consent mechanisms in the recording flow, but the legal responsibility for obtaining proper consent rests with you as the Customer.
5.4 Use of Content for Service improvement
We may use aggregated, anonymized usage data (e.g., total videos recorded, average completion rates) to improve the Service. We will never use your Content or your End Users' Content to train AI models or for any purpose beyond operating the Service for you.
6. Acceptable use policy
You agree NOT to use the Service to collect, host, embed, or distribute Content that:
- Is illegal, infringes intellectual property rights, or violates any applicable law.
- Contains nudity, sexually explicit material, or content harmful to minors.
- Promotes violence, hate speech, harassment, or discrimination based on race, religion, gender, sexual orientation, nationality, or any protected characteristic.
- Is defamatory, fraudulent, deceptive, or misleading (including fake testimonials, paid reviews presented as organic, or impersonation of real persons without consent).
- Contains malware, viruses, or any malicious code.
- Violates the privacy rights of any third party, including unauthorized recording of individuals.
- Was obtained without proper consent from the person appearing in the recording.
You also agree NOT to:
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated means (bots, scrapers) to access the Service except via official APIs.
- Attempt to circumvent rate limits, plan restrictions, or security measures.
- Resell, sublicense, or white-label the Service without a written agreement.
- Use the Service to compete with GetPureProof or build a competing product.
- Overload, attack, or disrupt the Service or the experience of other users.
- Submit fake testimonials about your own business or any third party.
6.1 Reporting violations
If you believe Content on the Service violates these Terms, report it to contact@getpureproof.com. We review all reports and act within a reasonable timeframe.
7. Suspension, termination, and content removal
7.1 Termination by you
You may close your Account at any time from the dashboard settings or by contacting support. Upon closure, your Subscription is cancelled and no further charges are made.
7.2 Termination for violations
We reserve the right to immediately suspend or permanently terminate your Account and remove your Content if you violate these Terms — including, without limitation, violations of the Acceptable Use Policy (Section 6), failure to pay, fraud, abuse, or any conduct that exposes GetPureProof or other users to legal, security, or reputational risk. In such cases, no refund is owed.
7.3 Termination for other reasons (30-day notice)
We may also terminate your Account or discontinue the Service for reasons other than violation — for example, business decisions, technical changes, or regional availability. In such cases, we will provide at least 30 days' written notice by email, during which you can export your Content and data. We will not charge you for any billing period that begins after the termination date.
7.4 Grace period for data export
After Account closure (whether by you or us, except for severe violations under 7.2), your data remains accessible in read-only mode for 30 days to allow export of videos and Spaces. After this grace period, all Content is permanently and irreversibly deleted from our systems and from our infrastructure providers.
7.5 Survival
Provisions that by their nature should survive termination (including Sections 5, 8, 9, 10, 11, 12, and 13) will remain in effect after termination of your Account.
8. Service availability and modifications
8.1 No uptime guarantee on standard plans
We aim for high availability and use enterprise-grade infrastructure (Cloudflare, Supabase, Stripe), but the Service is provided "as is" and "as available" without uptime SLAs on standard plans. Custom SLAs are available for enterprise agreements — contact us.
8.2 Maintenance and downtime
We may perform planned maintenance that temporarily affects Service availability. Where possible, we will give advance notice. Unplanned outages may also occur.
8.3 Service modifications
We may modify, add, or remove features at any time. For material changes that significantly reduce functionality of paid plans, we will provide at least 30 days' email notice. Bug fixes, security patches, performance improvements, and minor changes do not require notice.
8.4 Beta features
Features labelled "beta", "preview", or "experimental" are provided for testing purposes and may change, break, or be removed without notice. Beta features are excluded from any service guarantees.
9. Third-party services and data sharing
To operate the Service, we share necessary data with trusted third-party processors. These include but are not limited to:
- Stripe — payment processing
- Cloudflare — content delivery and storage infrastructure
- Supabase — database and authentication
- Google Analytics — usage analytics
- Meta Pixel — marketing analytics
- Email service providers — transactional and marketing email delivery
A full list of sub-processors and the categories of data shared is available in our Privacy Policy. By using the Service, you consent to this data sharing as necessary to operate the Service.
Third-party services have their own terms and privacy policies. We are not responsible for their practices.
10. Intellectual property of the Service
The Service itself — including its software, design, brand, logo, documentation, and underlying technology — is the exclusive property of WebCrafters Sp. z o.o. and is protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any rights to our trademarks, logos, or branding. You may reference "GetPureProof" factually (e.g., "powered by GetPureProof") but may not use our brand assets in any misleading or unauthorized way.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.
Nothing in these Terms excludes or limits any warranty, right, or liability that cannot be excluded or limited under applicable law.
12. Limitation of liability
To the maximum extent permitted by law, GetPureProof, WebCrafters Sp. z o.o., and our directors, employees, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, business opportunities, or goodwill.
- Damages resulting from third-party services, content submitted by you or End Users, or use of the Service in violation of these Terms.
Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the amounts you paid to us in the 12 months preceding the event giving rise to the claim, or EUR 100, whichever is greater.
This limitation applies regardless of the legal theory of the claim (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless GetPureProof, WebCrafters Sp. z o.o., and our affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms.
- Content you or your End Users submit, embed, or distribute through the Service.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Your failure to obtain proper consent from End Users for recording and use of their Content.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision.
For material changes (e.g., changes to payment terms, content rights, or liability), we will notify you by email at least 30 days before the change takes effect. For non-material changes (clarifications, formatting), we may update the Terms without notice.
Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may close your Account.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Poland, excluding its conflict-of-laws principles.
Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively by the competent courts in Poland, with jurisdiction determined by the registered office of WebCrafters Sp. z o.o.
For EU consumers, this clause does not affect your right to bring proceedings in the courts of your country of residence as guaranteed by EU consumer protection law.
16. Miscellaneous
- Entire agreement — These Terms, together with the Privacy Policy and any additional terms agreed in writing, constitute the entire agreement between you and GetPureProof regarding the Service.
- Severability — If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- No waiver — Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment — You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure — Neither party is liable for delays or failures caused by events outside reasonable control (natural disasters, war, internet outages, government actions, etc.).
- Notices — Legal notices to us must be sent to contact@getpureproof.com or to our registered office address listed in Section 17. Notices to you may be sent to the email address registered with your Account.
